01Agreement to These Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and our Compliance Policy, which are incorporated by reference. If you do not agree, do not use the Services.

You must be at least 18 years old and able to form a binding contract to use the Services. If you use the Services on behalf of another person or household, you represent that you are authorized to do so.

02What BeyondWallsPay Is — and Is Not

BeyondWallsPay is an information, search, and referral service that helps families and friends locate a loved one held in a participating county jail and identify the official, licensed providers and steps needed to support them — such as the facility’s official commissary and phone providers.

• We are not a bank, money transmitter, money services business, or payment processor, and we never take custody of, hold, or move your funds.
• We are not a law firm, bail bond company, or licensed financial, legal, or correctional adviser.
• We do not control the jails, providers, agents, attorneys, or other third parties we identify or refer, and we are not responsible for their services.

When you send money for commissary or phone service, you do so directly with the facility’s official, licensed provider on that provider’s own system. Your payment never passes through BeyondWallsPay.

03Your Account

To search and use most features, you must create a free account using a valid email address and a password. You agree to provide accurate information and to keep it current.

You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly at support@beyondwallspay.com of any unauthorized use. You may not share your account or create an account for anyone under 18.

04Free Search and BWP+

Creating an account and searching the county jail systems in our coverage — including viewing the official providers and deposit steps for a located person — is free.

BWP+ is an optional, enhanced tier purchased for a single, one-time fee per incarcerated person. BWP+ may include features such as booking-watch and status alerts, referrals to bail bond agents and attorneys, connections to chaplains and a community, and facility-specific guidance. BWP+ is not a subscription; the one-time fee unlocks the included features for the specified person.

Prices, features, and availability of BWP+ may change over time; the price and scope shown at the time of purchase apply to that purchase. Payments are processed by a third-party payment processor, and we do not store full payment card numbers.

Except where required by law, BWP+ fees are generally non-refundable once the enhanced features have been made available. If you believe a charge was made in error, contact us and we will review it in good faith.

05Third-Party Providers, Referrals, and Listings

The Services identify and may refer you to independent third parties, including official commissary and phone providers, bail bond agents, attorneys, chaplains and faith organizations, and other resources. These parties are not employed by, controlled by, or partners of BeyondWallsPay unless expressly stated.

Listings and referrals are provided for your convenience and are not endorsements, recommendations, guarantees, legal advice, or financial advice. Any transaction or relationship you enter into with a third party is solely between you and that party and is governed by that party’s own terms and pricing. You are responsible for evaluating any third party before engaging them.

Attorney and bail bond referrals are informational only and do not create an attorney-client, agency, or fiduciary relationship with BeyondWallsPay. We do not practice law or provide bail services.

06Pulse AI and Informational Content

Certain features, including our “Pulse” help engine, use automated systems and artificial intelligence to provide general information about how BeyondWallsPay works and how to support a loved one. This content is informational only and may be incomplete, out of date, or inaccurate.

Pulse and other content do not constitute legal, financial, correctional, or other professional advice. Always verify important information with the facility, the official provider, or a qualified professional before relying on it.

07Notifications and Text Messaging

With BWP+, and where you opt in, we may send you notifications by text message (SMS), email, or push notification — for example, booking-watch and status alerts. Alerts are generated from third-party and public records that may be delayed, incomplete, or inaccurate, and we do not guarantee that any alert will be timely or correct.

By providing your mobile number and opting in, you consent to receive messages from or on behalf of BeyondWallsPay at that number, including via automated technology. Message and data rates may apply. You can opt out at any time by replying STOP to a text or adjusting your settings; opting out of alerts may limit BWP+ features.

08Community and User Content

BWP+ may include a community where families can share experiences. You are responsible for content you post and must have the right to share it. Do not post others’ private or sensitive information, or content that is unlawful, harassing, hateful, deceptive, or that could endanger an incarcerated person or anyone else.

You grant BeyondWallsPay a non-exclusive, worldwide, royalty-free license to host, display, and moderate your content for the purpose of operating the Services. We may remove content or restrict accounts that violate these Terms, at our discretion.

09Acceptable Use

You agree not to: (a) use the Services for any unlawful, fraudulent, or harmful purpose; (b) access, scrape, harvest, or copy data except as the Services intend; (c) interfere with or compromise the security or integrity of the Services; (d) impersonate any person or misrepresent your affiliation; or (e) use information obtained through the Services to harass, defraud, surveil, or harm any incarcerated person or other individual.

10Intellectual Property

The Services, including their design, text, graphics, software, and the BeyondWallsPay and Pulse names and logos, are owned by BeyondWallsPay or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended personal, non-commercial purpose. All rights not expressly granted are reserved.

11Records, Coverage, and Accuracy

Search results, facility and provider information, and alerts are derived from jail systems, official providers, and public records that we do not control. Coverage is limited to participating county jail systems and expands over time. We provide this information “as is” and do not warrant that it is accurate, complete, current, or available for any particular person or facility. Always confirm a person’s current facility and the correct official provider before sending money or relying on any information.

12Disclaimers

To the fullest extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty regarding accuracy, reliability, or results. We do not warrant that the Services will be uninterrupted, secure, or error-free.

13Limitation of Liability

To the fullest extent permitted by law, BeyondWallsPay and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of funds you send to a third-party provider, loss of data, or loss of goodwill, arising out of or relating to the Services.

Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us for BWP+ in the twelve months before the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14Indemnification

You agree to indemnify and hold harmless BeyondWallsPay and its members, officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Services, your content, your dealings with third parties, or your violation of these Terms or applicable law.

15Suspension and Termination

You may stop using the Services and close your account at any time. We may suspend or terminate your access, with or without notice, if we believe you have violated these Terms or applicable law, or to protect the Services or others. Provisions that by their nature should survive termination will survive.

16Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws principles. Subject to the arbitration provision below, you and BeyondWallsPay agree to the exclusive jurisdiction and venue of the state and federal courts located in Salt Lake County, Utah.

Any dispute arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, seated in Salt Lake County, Utah and administered under the rules of a recognized arbitration provider, except that either party may bring an individual claim in small-claims court. You and BeyondWallsPay waive the right to a jury trial and to participate in a class or representative action. Where such a waiver is unenforceable, the dispute will proceed in the courts identified above.

17Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

18General

These Terms, together with the Privacy Policy and Compliance Policy, are the entire agreement between you and BeyondWallsPay regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control.
